Agreement

The use of SikhRishta website, mobile applications, and services provided by FIL N GO, Inc. (hereinafter referred to as “Company”) are subject to the following Terms & Conditions. This Agreement shall govern the use of the SikhRishta platform and any services provided (“Services”).

1. Definitions

Company, Us, We: FIL N GO, Inc., as the creator, operator, and publisher of SikhRishta, makes the platform and affiliated databases available to users.

You, the User: You, as the user of SikhRishta, will be referred to with second-person pronouns such as You, Your, or as User.

Platform: SikhRishta website, iOS app, Android app, and any related services.

Content: Any text, photos, messages, profile information, or other materials uploaded, posted, or transmitted through the Platform.

2. Acceptance

By using SikhRishta, You warrant that You have read and reviewed this Agreement and agree to be bound by it. If You do not agree, please discontinue use of the Platform immediately.

3. Age Requirement

You must be at least 18 (eighteen) years of age to use SikhRishta. By using this Platform, You represent and warrant that You are at least 18 years of age and may legally agree to this Agreement. The Company, owners and management assumes no responsibility for any misrepresentation of Your age.

4. Matrimonial Service Terms

4.1 Profile Accuracy: You agree to provide accurate, current, and complete information about yourself when creating your profile. Misrepresentation of identity, age, marital status, or other material facts is strictly prohibited and grounds for immediate account termination.

4.2 Single User Accounts: Each user may maintain only one active account. Creating multiple accounts is prohibited.

4.3 No Guarantee of Results: SikhRishta is a platform to facilitate introductions between individuals seeking matrimonial connections. We do not guarantee any specific outcome, match, or marriage resulting from use of our Services.

4.4 User Responsibility: You are solely responsible for verifying the identity and background of any users you interact with. We encourage users to exercise caution and meet in safe, public places.

5. User Obligations

When You register, You will choose a user identifier (email address or phone number) and password. You are responsible for maintaining the security of Your identifying information. If You discover that Your information has been compromised, notify Us immediately at sikhrishta@filngo.com.

6. Acceptable Use

You agree not to use SikhRishta for any unlawful purpose. You further agree not to:

• Harass, abuse, or threaten others
• Upload false or misleading profile information
• Use the platform for commercial solicitation or advertising
• Disseminate computer viruses or malicious software
• Perpetrate any fraud or scam
• Publish obscene, defamatory, or offensive material
• Collect information about other users without consent
• Use the platform if you are currently married (unless legally separated)
• Upload inappropriate, explicit, or offensive photos
• Use vulgar, abusive, or inappropriate language in profiles or messages
• Impersonate any person or entity
• Attempt to circumvent any content filtering or moderation systems

7. Content Moderation and Filtering

7.1 Right to Moderate: The Company reserves the absolute right to review, filter, moderate, refuse, or remove any Content uploaded to the Platform, at our sole discretion and without prior notice. This includes, but is not limited to, profile information, photos, messages, and any other user-generated content.

7.2 Automated Filtering: We employ automated systems and algorithms to detect and filter inappropriate content, including but not limited to: profanity, vulgar language, hate speech, sexually explicit material, nudity, violence, and other content that violates these Terms or community standards.

7.3 Photo Standards: All photos uploaded must meet our community standards. We reserve the right to reject or remove photos that are: inappropriate, explicit, or suggestive; not of the user themselves; group photos where the user is not clearly identifiable; photos containing offensive gestures, symbols, or text; digitally altered to misrepresent appearance; or otherwise deemed unsuitable at our sole discretion.

7.4 Language Standards: All text content must be respectful and appropriate. We reserve the right to filter, edit, or remove content containing: profanity or vulgar language; hate speech or discriminatory language; threats or harassment; sexually explicit language; spam or promotional content; or any language deemed inappropriate for a matrimonial platform.

7.5 No Liability for Moderation: You acknowledge that the Company is not liable for any Content that is removed, filtered, or modified, whether by automated systems or manual review. You waive any claims against the Company arising from content moderation actions.

7.6 Reporting: Users may report inappropriate content or behavior through the Platform's reporting feature. We will review reports and take appropriate action, which may include content removal, warnings, or account termination.

8. Child Safety and Exploitation Prevention

8.1 Zero-Tolerance Policy: SikhRishta has a zero-tolerance policy for child sexual abuse and exploitation (CSAE). Content or conduct that sexualizes, endangers, exploits, or facilitates harm to minors is strictly prohibited on the Platform and will result in immediate account termination.

8.2 Age Eligibility: As stated in Section 3, SikhRishta is restricted to users who are at least 18 years of age. This age requirement exists in part to prevent minors from accessing the Platform.

8.3 Reporting Concerns: If You become aware of any content or behavior on the Platform that You believe involves CSAE or CSAM, You may report it to Us at sikhrishta@filngo.com.

8.4 Removal of Violating Content: Upon obtaining actual knowledge of CSAM or CSAE content on the Platform, We will take appropriate action, including removal of the content and termination of the associated account.

8.5 Legal Compliance: We comply with applicable child safety laws and regulations, including reporting confirmed CSAM to the National Center for Missing and Exploited Children (NCMEC) or the relevant regional authority, as required by law.

9. Subscription and Payments

9.1 Subscription Tiers: SikhRishta offers a Free tier and one or more paid subscription tiers. Paid subscriptions unlock additional features as described in the app and on our pricing page at the time of purchase.

9.2 Billing and Auto-Renewal: Paid subscriptions are billed in advance on a monthly or annual basis and AUTOMATICALLY RENEW at the end of each billing period unless cancelled. For web subscriptions, you authorize us to charge your payment method on file for all applicable fees. Prices are displayed in your local currency where available. For in-app purchases, billing, renewals, and displayed prices are handled by Apple or Google as described in Section 9.10.

9.3 Pricing: Prices may vary by region and are subject to change. We will notify you of price changes at least 30 days before your next renewal. Continued use after a price change constitutes acceptance of the new price.

9.4 Cancellation: You may cancel your subscription at any time. Web subscriptions can be cancelled through your account settings or by contacting us at sikhrishta@filngo.com.Subscriptions purchased through the Apple App Store or Google Play must be managed and cancelled through your Apple ID or Google Play account subscription settings, as we are unable to cancel app-store subscriptions on your behalf. Cancellation takes effect at the end of your current billing period, and you retain access to paid features until it expires.

9.5 Refunds: Except where required by applicable law, web subscription payments are non-refundable, including for (a) partially used subscription periods; (b) unused features; (c) account inactivity; (d) voluntary cancellation; (e) account termination due to Terms violations; or (f) dissatisfaction with matches or results. In-app purchases made through the Apple App Store or Google Play are subject to the refund policies of Apple or Google, respectively, which act as merchant of record for those transactions; refund requests for in-app purchases must be directed to the applicable app store. Nothing in this section limits any non-waivable statutory rights you may have under the consumer-protection laws of your jurisdiction, including, where applicable, withdrawal or cancellation rights in the European Economic Area.

9.6 Upgrades: If you upgrade your subscription (e.g., Basic to Premium, if available), you will receive a prorated credit for the unused portion of your current plan, applied toward the higher-tier subscription. The prorated difference will be charged immediately to your payment method on file.

9.7 Downgrades: If you choose to downgrade your subscription, the change takes effect at the end of your current billing period. No refunds, credits, or prorated amounts are provided for downgrades.

9.8 Failed Payments: If a payment fails, we may suspend access to paid features until payment is successfully processed. We may retry payment using the payment method on file and may request updated payment information. Continued failure to pay may result in subscription cancellation.

9.9 Taxes: All prices include applicable taxes based on your location. Tax amounts are calculated and collected as required by law.

9.10 In-App Purchases (iOS and Android): Subscriptions purchased within our iOS or Android app are sold and processed by the Apple App Store or Google Play, which act as merchant of record for those transactions. For such purchases: billing occurs through your Apple ID or Google Play account; renewals, cancellation, and management are handled through that account's subscription settings; plan changes, proration, and any credits are handled by Apple or Google according to their policies (the upgrade and downgrade terms in Sections 9.6 and 9.7 describe web subscriptions billed through Stripe); and refunds are governed by Apple's or Google's refund policies (Section 9.5). Applicable taxes are collected and remitted by Apple or Google as merchant of record.

10. Intellectual Property

You agree that SikhRishta and all Services are the property of the Company, including all copyrights, trademarks, and intellectual property. You agree not to reproduce or distribute any Company content without express written permission.

By uploading Content to your profile, You grant the Company a royalty-free, non-exclusive, worldwide license to display, reproduce, modify, and distribute Your Content on the Platform for the purpose of providing the Services. This license terminates when You delete Your Content or account, except for Content shared with other users which may persist in their message history.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Account Termination and Deletion

12.1 Termination by Company: The Company may terminate this Agreement and Your account at any time for any reason, including but not limited to: violation of these Terms; providing false information; engaging in prohibited conduct; uploading inappropriate content; using abusive language; or any behavior we deem harmful to the community. No refunds will be provided for accounts terminated due to Terms violations.

12.2 Your Right to Delete Your Account: You have the right to delete Your account at any time. You can delete your account directly through your account settings in the app or website, or by contacting us at sikhrishta@filngo.com. We will process your deletion request promptly.

12.3 Effect of Deletion: Upon account deletion: (a) Your profile will be immediately removed from public view; (b) Your personal data will be permanently deleted within 90 days; (c) Messages you sent to other users may persist in their accounts; (d) Payment records will be retained for 7 years as required by law.

12.4 Inactive Free Accounts: Free accounts with no activity for 90 consecutive days may be automatically deleted. We will attempt to notify you via email before deletion.

12.5 Paid Account Expiration: If your paid subscription expires and is not renewed, your account will be downgraded to a free account. Profile data for expired paid accounts will be retained for no later than 90 days from subscription expiration.

13. Disclaimer of Warranties

Your use of SikhRishta is at Your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Company disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF SIKHRISHTA, INCLUDING BUT NOT LIMITED TO: damages for loss of profits, goodwill, data, or other intangible losses; damages resulting from interactions with other users; or damages arising from content moderation actions.

The maximum aggregate liability of the Company shall be limited to the amount You paid to the Company in the six (6) months preceding the claim, or one hundred ($100) US Dollars, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: Your use of the Platform; Your Content; Your violation of these Terms; or Your violation of any rights of another party.

16. Governing Law

This Agreement shall be governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles. Any disputes shall be submitted to the exclusive personal jurisdiction of the state and federal courts located in Camden County, New Jersey, USA.

17. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
